GoForward, Inc. and its affiliates, including its affiliated medical service providers (collectively, "Forward", "we", "our", or "us") provide these Text Message Terms & Conditions ("SMS Terms"), which govern the provision and delivery of SMS text messages by us and our text message service providers to you.
By "Opting In" to or using a Forward "Text Message Service" (both terms defined below), you accept and agree to these SMS Terms and to our Terms of Use, found at www.goforward.com/legal/terms. Generally speaking, under our Terms of Use, disputes are to be resolved via binding arbitration (and with very limited exceptions, not in court), and you waive any right to participate in class actions. By Opting In, you agree to resolve disputes arising under these SMS Terms pursuant to Forward’s Terms of Use, including the terms pertaining to binding arbitration and to class actions.
"Text Message Service" includes any arrangement or situation in which Forward sends (or indicates that it may send, or receives a request that it send) one or more text messages.
"Opting In", "Opt In" and "Opt-In" refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, or otherwise consenting to receive one or more text messages.
Any capitalized terms not defined herein have the meaning given in our Terms of Use found at www.goforward.com/legal/terms.
We provide Text Message Services to our Users and to other individuals who express interest in receiving information about our Service. We or our service providers may send text messages to provide you with information you request from us, inform you of aspects of and updates to our Service that may be of interest to you, address billing and collection issues, handle sign-up, and respond to your inquiries. We may also send text messages regarding various aspects of Users’ medical care, which may include, but shall not be limited to, wait times, follow-up questions, test results, prescriptions, appointments, and patient satisfaction surveys.
You understand that email and standard SMS text messaging are not confidential methods of communication and may be insecure. You further understand that, because of this, there is a risk that these electronic communications— some of which may contain information about your medical condition and care—might be intercepted and read by a third party. Password-protecting mobile device(s) and enabling encryption, if available, is recommended.
The use and disclosure of Protected Health Information (PHI) in text messaging may be governed by additional privacy notices, including Forward’s Notice of Privacy Practices found at www.goforward.com/legal/practices.
By Opting In to a Text Message Service:
After Opting In, in addition to the main messages the Text Message Service offers, you may receive one or more welcome messages or administrative messages, such as (in some cases) a request to confirm your Opt-In.
Forward does not charge you for its Text Message Service. Message and data rates may, however, apply. Depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.
Text Message Services may send multiple, recurring messages, whether that fact is noted or not. Forward may terminate any Text Message Service or your participation in it at any time with or without notice, including, for example, before you have received any or all messages that you otherwise would have received, but these SMS Terms still will apply.
Recipients of the Text Message Service may Opt Out by replying “STOP” (or “QUIT”, “END”, “CANCEL”, “UNSUBSCRIBE”, or “STOP ALL”) to any text message they receive from us.
Your Opt Out request may generate either a confirmation text or a text seeking clarification of your request. If you receive a clarification request, please provide the information necessary so that we can complete your Opt Out.
For help with the Text Message Service, recipients can reply “HELP” to any text message they receive from us.
Text Message Services may not be available on all mobile carriers and carrier participation can change without notice. Further, the content of Text Message Services is not compatible with all cell phone models. Forward is not liable for delayed or undelivered SMS text messages, as delivery of SMS text messages relies on effective transmission from your mobile carrier and compatibility of the message content with your device.
We reserve the right to modify these SMS Terms, or any part thereof, or add or remove terms at any time. Such modifications, additions, or deletions will be effective immediately upon posting. Your continued enrollment in Forward’s Text Message Service shall be deemed to constitute acceptance by you of such modifications, additions or deletions.
